Terms and conditions

This is a translation provided for your convenience. Only the German version is legally binding.

Last updated: October 2026

§ 1 Scope and provider

(1) These terms apply to all contracts for the purchase of digital murder mystery games via our website between Murdernight (provider details in the legal notice), hereinafter "we", and you as a customer.

(2) Conflicting terms of customers do not apply.

§ 2 Subject matter

(1) We sell digital content: murder mystery games as PDF files for download, in part bundled as a ZIP file. Nothing is shipped. You do not receive a physical data carrier or printed materials.

(2) Many mysteries come in two versions telling the same case. The print version consists of PDF files for you to print yourself. The digital version consists of PDF files in phone format that you can send to your guests. You choose the version before buying; you can also buy both.

(3) The product page of each mystery describes its content in detail (number of players, duration, included materials).

(4) Technical requirements: to open the files you need a device with a current PDF viewer; for ZIP files a program to unpack them (available on common computers and smartphones); for the print version a printer. The download requires an internet connection and an email address.

§ 3 Conclusion of contract and ordering process

(1) The presentation of the mysteries in our shop is not a binding offer but an invitation to order.

(2) The ordering process:

  1. Add a mystery (and, where offered, the version) to the cart.
  2. In the cart, check your selection, confirm that the download may be provided immediately and click "Checkout".
  3. On the payment page of our payment service provider Stripe, enter your email address, payment method and payment details.
  4. By clicking the payment button you submit a binding offer to buy the mysteries in your cart.

(3) The contract is concluded when we accept your offer: by sending the order confirmation by email or by providing the files for download after payment, whichever happens first.

(4) Correcting input errors: in the cart you can remove mysteries. On the payment page you can change your details at any time until you click the payment button. Your browser's "back" button or the back link takes you back to the cart. Nothing is binding before you click the payment button.

(5) The contract languages are German and English. The German version of these terms is authoritative.

(6) We do not store the contract text separately and do not make it available online after the purchase. You receive the order details, these terms and the cancellation policy with your order confirmation by email. You can also view and print these terms on this page at any time.

§ 4 Prices and payment

(1) The prices shown at the time of the order apply. All prices are final prices in euros. As a small business under § 19 UStG (German VAT Act) we do not charge VAT. There are no shipping costs.

(2) You can pay with the payment methods shown during checkout, in particular credit card, PayPal and Klarna. Payment is processed by Stripe. For PayPal and Klarna the terms of the respective provider also apply.

(3) The purchase price is due immediately upon conclusion of the contract.

§ 5 Provision of the files

(1) After successful payment you can download the files immediately on the confirmation page. You also receive an email with a link to your files. The link is valid for 7 days.

(2) Please download the files within this period and keep a copy. If the link has expired, you can request a new link on the download page using the email address of your order.

§ 6 Rights of use

(1) The mysteries are protected by copyright. With your purchase you receive a simple, non-transferable right to use the mystery you bought for your own game nights.

(2) You may in particular:

  • print the files as often as you like for your own game nights,
  • pass on or send the materials and files to the guests of your game night (e.g. by email or messenger),
  • play the mystery among friends and family as well as at parties of clubs or companies (e.g. a Christmas party).

(3) You may not:

  • sell, rent out or otherwise pass on the files to people outside your game nights,
  • make the files publicly available (e.g. for download on the internet),
  • stage the mystery at public or commercial events for an admission fee or other payment,
  • edit and publish the content or use it for your own products.

For commercial events, please contact us at info@murdernight.de.

§ 7 Warranty

(1) The statutory rights in the event of defects apply, for digital products in particular §§ 327 et seq. of the German Civil Code (BGB).

(2) If a file is faulty or cannot be opened, please contact us at info@murdernight.de and we will send you a correct file. Your statutory rights remain unaffected.

§ 8 Liability

(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee we have given.

(2) In the event of a slightly negligent breach of an essential contractual obligation, our liability is limited to the damage that is typical for the contract and foreseeable. Essential contractual obligations are obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely.

(3) Otherwise, liability for slight negligence is excluded.

(4) These limitations also apply in favour of our vicarious agents.

§ 9 Right of withdrawal

Consumers generally have a right of withdrawal. For digital content it expires early once we begin providing the files after you have expressly agreed to this and acknowledged the loss of your right of withdrawal. Details can be found in our cancellation policy.

§ 10 Dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 11 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer whose habitual residence is in another country, this choice of law applies only insofar as it does not deprive you of the protection afforded to you by the mandatory provisions of that country.

(2) Should individual provisions be invalid, the remainder of the contract shall remain valid.
